Legal Question in Family Law in Texas
Noncustodial parent needs help
I am the non-custodial mother of two boys. My ex and my mother teamed up with my current husbands ex and created a nightmare for all of our children. My two boys are 6 and 11. My ex took my 6 yr old for summer visitation and never brought him back. On the day I went to file a writ of habeas corpus (I think that is what it is called), he filed for custody. The judge granted it. Never gave us any grounds or anything. He since hired an attorney and had some false documents drawn up. They got away with it too b/c they waited until the judge left office and the new judge signed the fraudulant orders. Now I have proof that my ex is physically beating my child. CPS will not do anything about it. I am afraid to go back for custody b/c my ex has issued threats to me and with all of the other custody battles, we are broke. As soon as my ex got custody of my 6 yr old, my mother went for custody of my 11 yr old. They used the same lawyer. More lies and the judge granted her custody. That case is currently on appeal. The lawyer I have on that one is not doing us very good. We are broke. My main concern is my youngest son's welfare. I need help.

Re: Noncustodial parent needs help
If you are dissatisfied with your attorney, you can try to retain another one, but the new attorney will probably ask for a retainer. You may be able to find an attorney who will handle your case pro bono (no charge) by contacting your local Bar association. Also ask your local Bar association if there is a legal services organization that provides assistance to individuals with little or no income. You may also try contacting a local law school and ask if they have a law clinic that handles Family Law issues for low income persons. Good Luck.
