Non-custodial parent right to know about Protective Order
My current husband is a JMC over his 8 year old daughter from his previous marriage. After a custody battle for child abuse 4 years ago we lost due to the ex wife and boyfriend not telling the truth in a court evaluation, CPS, and in court. The ex wife has now taken out a Protective Order against this same boyfriend herself that backed her up in court. The child is listed on the Protective Order and the ex has played down and not been truthful about the child's involvment. We do not know what is in the Protective Order. We do have orders that stopped the mother and boyfriend from striking the child. Is my husband legally entitled to a copy of this Protective Order and could this change custody? We already have legal fees of over $30K that we are paying on. My husband is a recovering functional alcoholic that has not has a drink in 3 1/2 years, who has always visited and supported his daughter. The mother is an alcoholic and she denies it.

You can obtain a copy directly from the Courthouse. It is public record. You should also obtain a copy of the application and supporting affidavit from mom.
