Non-custodial Parent's Rights

I am an unwed mother. My son's father moved to a different state

before I gave birth and has not legally recognized my son or

offered financial help. My son is a pre-teen now, lives with me and

I am proud to say that he has my last name. I have allowed for the

father to see his son, under my supervision, over the years. Now

that my son is older what would happen if he becomes interested

in legally accepting the fact that he is the father? Would I have to

change my son's last name? Would he be forced to spend time

with his father? My son, although polite while he is in his father's

presence, has shown no interest in visiting him and staying with

him at all.

If his father files for paternity, then child support and health insurance would be addressed along with the child's last name, visitation, etc.

In Texas, if a father wants the child to have his name then the court will normally ordered it changed. In this case, since the child is 16, the court might not do it. The court would do it if the child wanted it done.

That is a very short answer to a complicated question.
