Legal Question in Family Law in Texas

how to obtain a restraining order before i apply for a divorce

my husband has a drug problem that is getting worse and worse. it got him so caught up that his family is invisible to him. he does'nt come home and when he does everyone is wrong but him. i informed that i am filing for a divorce and he needs to move out. i made a complaint to the hcpd because he came and took the deadbolt off our apartment door. the officer said i must at least get a restraining order before they can legally do anything. ten years of this in and out of rehab, and jail had just pushed me to the edge. i asked him to leave nicely that i am done, but he won't. i don't want to get in a physical fight with this man in front of our two daughters. i just want him to go. why won't he just leave? he's not here anyway. i need help, and i need something done asap to get this man out of my house.

You need to file for divorce and include a request for a temp. orders hearing and a temp. injunction.

It costs more but it's worth it.
