Legal Question in Family Law in Texas
Office of The Attorney General / Texas
Here I am again asking yet another question .
I am due to show up at the OAG's office in a few weeks .
For my ex not paying full amount of c/s . I've posted on here before .
STORY : 2 children I have always had full custody and received c/s of $400.00 a month for 2 kiddos . 1 child decided to live w/ Dad a while . And during that time it was agreed that he only pay for child still living w/ me . Now, I do NOT want that c/s back . I am only asking that he pay full amount once again . That both children live back w/ me . He says he shouldn't have to pay because he continued to pay for child living w/ me . I'm only asking him to once again pay full amount , and am asking for a modification since the last one was 6 years ago . Am I asking to much ? What do you think the OAG's will think about us not following the court orders ? Again I'm not asking for the c/s while 1 child lived w/ him . Only for him to be current for Sept. , and Oct. , plus a modification .
Do I need to worry about anything ? Is this a simple case . Since an order is already in effect ? And just needs to be honored ?

Re: Office of The Attorney General / Texas
First, always remember the AG does not represent you. It represents the State of Texas and is really only interested in making sure someone is paying child support.
Second, you really need an attorney to represent you in this. It really doesn't matter what the AG thinks about what you and your ex did. What matters is what the Judge thinks. An enforcement and a modification are more complicated than you seem to think.
Some attorneys will handle AG cases on a per appearance basis or will take payment plans. Find someone to help you with this mess.
