Legal Question in Family Law in Texas

Ok...so I have had my son since October last year. His mother agreed to this. He is 17. He wants to live with me and my wife. I have filed with the attorney general. We just got an appointment to see them and went today. His mother will not agree to me having custodialship. But did tell them that he moved in with me in October. I am filing through the district court. What legal form is there that I can fill out to request credit for the chikd support I paid from now back to october? I have every thing else handled. I just need advice on this. I am in texas. Thanks.

You need to hire a lawyer; forget about "legal forms." As you probably know, the Attorney General will help people in Court, but it does not REPRESENT those people. If the Attorney General officially represented those people, then they could sue the Attorney General for malpractice when their case gets screwed up. The Attorney General represents only the interests of the state of Texas. You can look this up � it's section 231.109(d) of the Texas Family Code.

You are entitled to what's known as "possession credit." This is addressed in section 157.008 of the Family Code.

You really need a lawyer; this could make a difference in some serious amounts of child support dollars.
