I have an open case for child support and custody, we have agreed on support and visitation, however when it was time to draw up papers to be signed and then set up a court date to get it approved with the judge, my lawyer passed away, my son�s father has lawyer and I was wondering if I need to get a new lawyer and re-pay a whole new retainer? Or is this something a can get a paralegal to do? Or can I just do it myself?

You should get another lawyer. Contact the office of your deceased attorney and find out whether they have someone else at the firm to handle your case. If not find out the balance of your retainer hire a new lawyer and have your file sent to the new lawyer and the retainer balance sent to you.
If your attorney was a solo practitioner, and there's not anyone left at the office for you to call, you might consider calling the State Bar--they try to provide help for clients in this situation and may be able to connect you with another attorney who's taking over your deceased attorney's cases. Even if that's not set up, they should at the least be made aware of the situation, and can provide you with some alternatives and suggestions.
