Legal Question in Family Law in Texas

what are options/restrictions to petition paternity? ex-wife filing complaint

What are the options for a father to petition the courts for a paternity test? are there any restrictions or statutes of limitations when paternity can be questioned? If an ex-wife has filed a complaint with the attorney general for child support but the ex-husband is not the biological father, how would he go thru the courts to disprove paternity, end child support payments and stay out of jail? (the mother has openly admitted this is not the father, did not let him sign the birth certificate and does not listed him as the father on medical forms, school documents, etc)

You can petition the court for DNA test. It will cost you some money - $550-$700, but it would be worth it in the long run. But, if you are paying child support, there has already been a judicial finding that you are the father. Maybe you didn't contest it when you first had the chance. Might be too late now.
