Legal Question in Family Law in Texas

Order of Witholding for Modification of Child Support

I would like to know whose legal resposibilty it is to file a modified child support witholding order with the courts. Also, is it up to the courts or the individual to make sure the employer is provided a copy of the new order? My child support was modified in '97, no witholding order was ever filed with the courts and my employer did not receive any notification. There was a modified divorce decree also, signed by the judge stating the new amount. That I do have. Please help. I am being told that it was my resposibilty to make sure it was filed and sent to my employer. I thought that was what I paid the attorney for.

Re: Order of Witholding for Modification of Child Support

That is what you paid the attorney for, but he/she is not the one ordered to pay the child support. It is your responsibility to make sure these orders are properly presented to your employer. If your attorney didn't do something, that is a separate issue between you and your attorney. Maybe you have a claim against him/her for his failure.
