overnight visit

my son is 15 who refuses to stay overnight on mid week visits, citing school work, etc, but I do pick him up then take him to dinner then back to his father's. My ex is taking me to court to modify support because of me not keeping the child those nights. My ex makes 4 times more than I and am worried that the court will rule in his favor which will cause me to lose my home. What are my chances of this?

Re: overnight visit

Child support and child visitation are separate issues.

Child support is presumptively based upon the obligor's income.

It is very unlikely that a Court would modify a child support obligation due solely to a change in the midweek visitation schedule.
