Legal Question in Family Law in Texas

Overpayment of Child Support

I was stationed overseas when my divorce was going on. I had no representation and the court ordered 20% of my ''gross'' income in Child support, including the money that would stop at my divorce, ie. Allowance for housing, Family Separation Pay. I have been paying for 2 years and need to know what to do. im still overseas in the military now, so is this a feasible question?

Thank you in advance,

Ray Eakes

Re: Overpayment of Child Support

You must file a legal document called a MODIFICATION in order to ask the court to lower your child support payments. In the document, you could ask that the lower payment be made retroactive from the date of the filing of the document.

I encourage you to file as soon as possible since the court cannot lower child support payments unless there is a legal document on file asking the court to modify their last order.

If your case was in Harris or Fort Bend counties, you can email or call my office for more information and prices.
