Legal Question in Family Law in Texas
Do I owe back child support
My divorce was finalized as of 28 Oct 2005. My ex-wife and I had been separated since 1 May 2005. During the divorce proceedings, it was determined that I would pay $217 per month for child support starting 1 Nov 2005. It was also determined that I owed back child support for the period between 1 May 2005 and 1 Nov 2005, and that I would have to pay this at the rate of $102 per month for 12 months starting 1 Nov 2005. I received my copy of the final decree on 10 Dec 2005. In the section about child support, it orders me to pay the $217 per month, but there is nothing in there about the $102 per month for 12 months. Am I still obligated to pay this back child support?

Re: Do I owe back child support
Yes, you are obligated. Unfortunately, your attorney and opposing counsel did not read carefully enough the order sent to the Court. I would advise you to begin making these past due child support payments by separate money order and keep the stubs. You should also request your attorney to file a clarifying order for the past due language. If you don't, the court's docket sheet likely shows this ruling and your spouse can come back on you at any later time to get this money.
