Legal Question in Family Law in Texas

Owed Money from Adopting

My husband and I adopted a girl. In the papers we signed, we agreed to pay and additional $1,500.00 to cover any additional medical bills not covered by insurance. It has been almost a year now and they said they have not gotten any additional bills and they will not tell me when we will receive our money back. They quit responding to e-mails, won't return my call, even the owner of the agency will not respond. We have it in writing from them they would return the money - can you help?

Re: Owed Money from Adopting

Look to your written agreement and the receipt they gave you for the money. There are statutes of limitation which will prevent you from getting your money back if you do not take formal action within a specific time period. There may also be state licensing agencies which regulate the people who have your money. Start with a certified letter to them requesting the return of the money and enclose a copy of the written agreement and a copy of the receipt or cancelled check. After two weeks if you have not heard back, call and talk to the manager or as high as you can get in the organization. Ask if they are licensed and ask for their license number and see if they have the number for the agency which licenses them. If they do not call you back in three or four days, file a complaint with the licensing agency. If nothing is settled within about eighteen months from the time you gave them your money in the first place, you may wish to visit with a lawyer in your town.
