Ownership of home at Divorce - Texas

If I divorce in TX, is it law that the home will be split in 1/2? My husband says because he used proceeds from the sale of his previous home (with his exwife) as down payment that I would not be entitled to anything on our current home if we divorce. I thought in TX it was community property. 1/2 is mine. Please help.

I doubt your husband is an attorney.

Yes, you are correct. Texas is a community property state.

That said, if he put in "separate property funds" and he can prove it, then he might be entitled to get that money back.

I strongly suggest that you hire an attorney and quit listenging to your husband!
