Legal Question in Family Law in Texas

Parental RIghts & Child Support

My fiance has a daughter she does not have his last name or is he on the birth certificate. He never married the childs mother, and now wants to give up complete custudy since he was denied visitation by the mother. Even though he gives up his rights can the baby's mother make him pay child support?

Re: Parental RIghts & Child Support

Yes. The law expects both parents to support their children, regardless of issues between the parents. He can go to court to enforce his visitation rights. Rarely will a court allow a termination of parental rights, without another parent stepping in to take over the responsibilities.
