Parental rights of never married parents

My child's father and I were never married in name or common law. He acknowledged our child on her birth certificate and has a relationship with her. Our child lives with me and her father does not pay child support. His sole financial contribution is to cover half of her daycare tuition. We have never gone to court to get a legalized custody agreement. He feels that we have equal rights to her and he can do as he pleases where she is concerned. Is this true? Does he have any legal parental rights without suing for them in a court of law?

Child support is based on his monthly net resources. His paying 1/2 of child care may be less or more than he would pay in child support. If he is ordered to pay child support, then daycare becomes your sole responsibility.
