Legal Question in Family Law in Texas

Parental rights

Can the mother of a 2 month old baby keep the father from seeing the child if they have never been married when the father wants to support and help with care and if she does not consent how can he legally see the child and possibly obtain a dna test?

Re: Parental rights

Based on what you have written, the father would need to file an action in the appropriate court to establish paternity and protect his rights and interests. I agree with Jeffrey.

You need to file a paternity lawsuit. Then you would be ordered to pay child support, carry health insurance, get a DNA test and get court ordered visits with the child.

The filing fee in Harris county is under $300.

If she won't agree, you would need to ask the court for a temporary order hearing.

My rates are very reasonable based on my years of experience.

My deposit would be $900 that would include filing fee, service fee, temp. order hearing.

Then you'd make a monthly payment to me.

How much? Depends on how much work I need to do.

Re: Parental rights

The simple answer is -- in the long run she can't. If the father files a paternity action and is proved to be the father he will get his rights. If she ignores the law suit he could end up with custody.
