Legal Question in Family Law in Texas

Parental rights termination

I have Sole custody of my chld. The father is over $12,000.00 behind in c.s. He is currently in jail in a drug rehab program, and has been there since 11/2006. He will be getting out in Oct and placed in a half-way house. Since he has never paid c.s and was in jail on 2 chrgs one being drugs, can I have his rights terminated. If not do I have to let let my chld (who is female) visit him in the half way house? She does not want anything to do with him at this point. He was granted one weekend visit a mnth with a 14 written notice. He has already advd that he will be contacting me as soon as he gets out and I know he is going to want to see our child. Will she haft to go? She is on the school dance team and will have that all weekafter school and the games, and will be wrkng weekends. Can he force her to give up those things? He has not been in her life for over 4 yrs now. To reinterate 1) can I have rights terminated and 2) can he force her to visit and give up the activities she has work hard for?

Re: Parental rights termination

You may be able to terminate his rights. Even if that isn't done, a Court will most likely restrict his visitation. I can't imagine him having forced regular visitation at a half way house. I would suggest you talk to a local attorney and see what your options are. However, don't just decide that you will keep your child from him if the order provides for it. You need to get a court modification of his visitation rights.
