Legal Question in Family Law in Texas
My parents are both 70 and have not lived with one another as a married couple for at least 15 years. They never divorced. My mom is wanting to purchase a home, but is being told she will need my dad to sign the paperwork with her. I do believe they still file taxes together. I know, I know... What are her options as far as purchasing a home on her own? Is there a way that she can do this without him being a co-signer? Thank you!

She is going to need to get a divorce, if she wants to use this home as collateral on a mortgage, without his involvement. They are still married, and all of the assets and debts accumulated during the past 15 years are community property.
