Paternity Question

I have been separated for a year and a half but have not been legally divorced. I am pregnant with my boyfriends child and now cannot get a divorce until the baby is born I've been told. If I can't get a divorce then who's name will go on the birth certificate. Will it be the father of the baby or my husband since we are still not divorced?

Don't put your husband since he is not the father of the child.

The divorce can be finalized once the baby is born.

Some courts will require that the father be ordered to pay child support.

A few courts require DNA testing to be on file to prove that the husband is NOT the father.

You need to talk to your attorney and make sure that you get everything done that the court will require to finalize this divorce.
