Legal Question in Family Law in Texas

Paternity Verification

An ex-girlfriend of mine recently gave birth to a child in Texas that she claims I am the father of. She has not requested any child support or parenting assistance of any form. And, the birth was out of wedlock. I have a feeling that my chances are slim, but can I legally have a paternity test conducted in this case?

If the child is mine, what rights do I have to visiting and parenting the child? Can she still seek child support at some time in the future?

Re: Paternity Verification

You can request a paternity test in a Suit Affecting the Parent Child Relationship. If you are found to be the father, you may assert your visitation rights (which will likely be minimal until the child is 3-5 years old) along with your obligation to pay child support. It's not a bad idea to do this ASAP because she may seek child support sometime in the future and you would likely be required to pay child support from birth to date of judgment as arrearage plus interest, court costs and attorneys fees.
