Do I need permission from my spouse to move out of state with my child?

We have been married for 12 years and separated now for one year. He comes and goes between his mother's home and mine. My child is 7 years old and he does not support us. I want to know if I need a notarized affidavit or some other legal document to move out of state with my child. Does he needs to agree with the move since he has never support us? Two weeks ago he call me and stated he wanted a divorce.

Unless there's a court order prohibiting you from doing so, you can move out of state with the child.
