can a person sue a spouse and someone they had affair with, because they cheated on them during their marriage?

No. All you can do is get a divorce. Many years ago, there was such a law, but no more. Texas is a no-fault divorce state, so anyone can get a divorce for any reason. However, if the affair led to the breakup of the marriage, and you can prove that, then there may be a basis for the court to award one you a greater portion of the property.
