Legal Question in Family Law in Texas
Petition court to move case to another county
I am about to move and can move within the state(Tx), Can I ask the court to move my case to the new county in which I will live or do I have to wait unti I live there 6 mos. I have a feeling my ex will file for custody even if to cause me to have to go to court and make me spend money. His attorney is his uncle. If I can get it out of his jurisdiction it would sure be easier on me.

Re: Petition court to move case to another county
Based on what you have written, jurisdiction is established upon where you and your children reside. Generally, being in Texas for six months and in a specific county for ninety days will establish jurisdictional requirements. If you wish to transfer your case into another county; you generally need to file a motion for transfer in the county where your and your children reside for ninety day period, assuming that you have been in Texas for six months.
