Petition For Divorce Divorce

My ex-wife and I have sepatated for 7 years she lives with her 1st husband

and they have a 5-6 year old son Our

son and daughter are over 20 They re-fuse to file and pay for the divorce

Do I file with/without children and what are the best grounds for uncontested responce

As your children are adults there is no need to file a Suit Affecting the Parent Child Relationship which is required companion suit to a divorce with minor children. Unless you are seeking a disproportionate share of the community estate, the standard "no fault" cause of action is sufficient (insupportability). You would be well served to hire an attorney to help you. This may save you a lot of time and expense down the road. Good luck.
