Petition for Guardianship of Niece

My husband and I have been taking care of my niece my brothers daughter for about a year now she lives in our home. She refuses to live with him and he refuses to give me custody. Her Mother is deceased and my brother is looking at jail time for lack of child support on another child. My niece is older then 12 and has expressed how much she would rather live with my husband and I. Is there a way I can get custody or legal guardianship of her without his consent?

You have standing to bring a lawsuit for custody of the child. It's called a Suit Affecting the Parent Child Relationship.
