Is a petition needed to protect the child in a joint custody case with unmarried parents

I don't understand your question. Petitions are documents filed to initiate allegations in a lawsuit. If a Suit Affecting Parent Child Relationship is already pending, then the petition has already been filed; hence the existence of a joint custody case.
