Legal Question in Family Law in Texas

Phone contact & harrassement charges

Can I file telephone harassment charges against my fiance--name removed--ex wife? My fiance and I live together and are getting married next month. His ex wife has constantly called my house in the past just leaving outrageous messages with a lot of profanity, threats, etc.... A few times she will hang up on me when I answer the phone. The only reason for her to have the phone number is because of their son. Instead of calling and asking politely or leaving a pleasant message - she will often times curse or demand that I put their son on the phone. If he is there, I have no problem but when he is not I tell her that they are not home she will rant, rave, curse, and have a fit. I will hang up. She will call back several times thereafter leaving nasty messages. I have them all saved and I want to change my number.

How would this affect my fiance--name removed--son if I change the number and not advise her of it and just have the child call with my number blocked. Would my fiance need to request a modification? Am I right in filing harassment charges if her behavior continues?

Re: Phone contact & harrassement charges

Why notlet the kid use the phone number she knows and you get an unlisted phone number that you use for your friends and family.

Or get the kid a cell phone.

The parents are ordered (you would need to read the decree) to keep the court, the other parent, etc. informed as to ANY address or phone number changes. If the father does not do so, then he's in contempt of court.

Of course, the father can file a modification and/or contempt on the mother.

In addition to the earlier reply, I would also suggest that you get an inexpensive telephone recorder/answering machine so as to document the type of call and the frequency of the calls. If you can establish the harrassment, then you can file on your own behalf, and your husband can file on his behalf. TCL
