Legal Question in Family Law in Texas

out of pocket medical expences/deductible

My ex and I are each responsible for 50% of out of pocket med expenses. She is remarried with a plan that has a $10,000.00 family deductible covering 6 people including my 2 children. This year my daughter used over that amount but so did my ex and her other children. Am I responsible to meet 1/2 of the family deductible or 1/2 of 1/6th for each of my girls? Thanks

Re: out of pocket medical expences/deductible

You are certainly not responsible for persons other than your daughters. If you cannot agree on a number, it would have to be presented to the court. Your method of calculation is one fair way of allocating the deductible. Another fair way would be to allocate on the basis of each covered person's pro rata share of medical expenses. There may be others.
