Possessory parent refuses to abide by modification.

re: over 100 mile rule- modification states each parent must make travel arrangements and pay for the trip from the airport nearest the residence of the conservators. Possesory parent refuses to abide by modification by not making her reservation for the childs return. Is this contempt? If so, what can be done?

Enforcement of visitation

Yes, failure to follow all the rules set for visitation are enforceable by contempt. File a motion to enforce. The judge can order withholding to have the funds available to pay the stubborn spouse's portion of the flight. The jduge can also jail the stubborn spouse until payment is made for all past flights for which you paid and all ancillary costs. You must file the motion to enforce and let the court do its job.
