Legal Question in Family Law in Texas

power of attorney

My fiance (joe) had a mental breakdown and has been hospitalized for the past month...Now his father states he has gotten a power of attorney and says he wants joe's belongings from our apartment and doesn't want to have to call the marshall! What are my rights here?

You have the right to consult an attorney of your choice. You will not be burdened by an incompetent court appointed attorney. If you cannot afford an attorney, your may plead your case to the judge by yourself. Without legal training be prepared to lose and pay the opposition everything they are asking. Good Luck.

This sounds there is history here between you and Joe's dad. If this is a new POA and Joe is in the mental hospital he may not have been competent to make it but if this is an older POA it is probably valid and his dad has every right to come get his stuff. Is there some reason you don't want to give his Dad his stuff? That's the easy solution.
