Legal Question in Family Law in Texas

power-of attorney, wills

We have recently found out that a new power of attorney has been done on my husbands elderly, sick mother - naming his sister-in-law. Also: my mother-in-law received a 27,000 insurance check on her house, which went into her bank account & was then removed by the sister-in-law. (We had to dig to find out this information.) My mother-in-laws will is missing & my sister-in-law is flashing her power-of-attorney like a weapon - because she was not included in on a medical procedure decision for my mother-in-law. Help.

Re: power-of attorney, wills

Being elderly and sick does not mean that she is incompetent. If she has knowingly provided this power, then there is very little, if anything, you can do. Obviously, the question of fact is, is she competent? If not, then the sis-in-law may be taking advantage of the situation. See a lawyer.
