Legal Question in Family Law in Texas
Pregnant Minor w/ parent living in Texas and minor is in Illinois.
Pregnant Minor who turns 18 Feb.12,2004 is currenlty in Illinois under the care of someone other than her parents who live in Texas.She is in Illinois because she needs to be near the adopting parents of the child the baby's dad.Her parents want her to come back to Texas to live there even though just 3 weeks ago they kicked her out.Now that she is here where they told her she had to go they are trying to make her go back.She & everyone else including the adoptive parents, the dad, the dad's family,know what kind of household she would be going back to, know she is in better care here in Illinois & don't want her to.Her parents are alcoholics in the making & they supposedly ''quit'' doing cocaine. They are verbally abusive to her & her brothers.They haven't taken her to a doctor in 3+ months.Now making it next to impossible to get her seen by a doctor.Now the people she is staying with don't want her staying there any more & her dad is not willing to let her stay with the baby's dad and his family.Her dad is saying she has to stay where she is or come back to Texas, but where she is, she is no longer wanted. Does she have to go back to Texas even though her parents had kicked her out originally?

This is a tough one. Possibly, she could apply to the courts for an emergency order of protection to possibly allow her to be removed from the home. If the boyfriend's family is willing to take her, they would need to be involved to show they could be responsible for her. Also, she can contact DCFS and have them intervene on her and her brothers' behalf. There are many options but I would not go it alone.
