Legal Question in Family Law in Texas

pregnant teen

We just found out out 16 yr dghtr is pregnant. What are are financially responsible for this preg. since she is a minor. Right now we are thinking about telling her that she can either terminate the pregancy and stay home for as long as she needs or if she has the baby she will be financially resp. for everything, prenatal care, hospital and cost after the baby, daycare, formala etc.. And that she will have to move out when she turns 18 (in the yr 2009) or when she graduates high school (2010). We have decided that she made the choice to engage in an adult acitvity and as such if FULLY responsible for the consequences. Oh and the father is 18, can we make him be fully responsible for everything as well? We do not want anymore children and feel we should not be made to be responsible for her decision to have a baby and have to raise this child because she thinks this all fun and games and when she is tired of it mom and dad will do it.

Re: pregnant teen

You can go to court and ask the father to support this child.

His child support will be based on his income. 20% of his net resources as defined by the TX Legislature.

Keep track of all pre-natal expenses too.

You need paperwork to document what you have spent.

The day she turns 18 she is an adult and you can ask her to move. If she won't you can legally evict her. It's simple, you go to the small claims court in your area of town and fill out the required paperwork. It will take awhile to get her in front of a judge and only he can evict her. You might want to get the paperwork now and find out from the judge's clerk what you need to legally do to have her evicted. Then you will be ready when she turns 18.

If she won't be responsible, then you will need to contact CPS if you don't want to raise this baby.

Of course, if CPS takes custody, you won't be able to see the baby.

If you want to know more, you can come into my office and we can discuss your options and questions for one hour for $150.
