Re: prenuptial agreement process

Based on your zip code I think you are in Harris County.

If you purchased the form off the internet, odds are that it is wrong.

If it came from NY, WA or CA, I've not seen a divorce decree from any of those do it yourself websites that work. However, I've never seen the pre-nupt. so I can't directly address it.

And, good luck with the 100% guarantee. I've not met one person who could get their money back.

Pre-nupts. require certain things to be valid -- such as both of you need your OWN attorney and ALL assets and debts must be disclosed.

Where do you file it? You don't!

Obviously, you need an attorney.

FYI - If you really want to protect yourself, a pre-nupt. is NOT enough in Texas. There is another form that An attorney that does a lot of family law will know!

I offer Do It yourself kits but since you both need an attorney to repesent you, I don't think a pre-nupt will work.

How much? Depends on assets, debts and are you willing to follow the master form or do you want a "personalized" pre-nuptial. The more work I do the more I charge.

Plus -- do you understand all of the implications of a pre-nupt? There are many ways to void the pre-nuptial. In fact, it is quite difficult to do everything required to actaully make it enforceable in the event of a divorce. Most people are not willing to do the work necessary to keep their separate property separate.

I charge $150 for one-hour consultation.
