Pre-Nuptial Agreements
My fiancee is being held jointly liable for a trust-fund recovery debt to the IRS with her ex-husband. We are therefore forced to have a pre nuptial agreement to protect my assets until the matter is resolved. Two questions:
1. Is it possible to get a reliable pre-nuptial agreement form off the internet for free or at a reasonable cost?
2. If not, what is a reasonable fee (or estimated time requirement) for an attorney to prepare one for us.
Our first quote asked for a $1,500 retainer--my guess is it would all be used if we were to pay that.

I would not trust any form downloaded from the internet unless you are familiar with applicable law. A mistake could be very costly.
Hard to say what is a fair fee for drafting the agreement. Depends on the specific facts of the case. However, ten hours is not unheard off. At $150 to $200 an hour, a retainer of $1500 is not out of line. In addition, the attorney can only represent one party. Another attorney will have to represent the other spouse. An attorney should not represent both parties and most will require that the other spouse have independent counsel.
