Private Investigator from another state

I would like to have a private investigator verify that my ex-husband is still drinking. His alcoholism is the primary reason his visitations are supervised. If I hire an investigator to follow him in Tennessee, does that investigator need to be present to testify in Texas, or can an affadavit suffice?

Affidavits cannot be cross examined. If you want his testimony (evidence) in, he/she would have to testify.
