Private Practice

Can a district attorney hold a private practice on the side? If yes, couldn't that be a conflict of interest when appearing in court?

Many years ago, I had a private real estate practice on the side, while an assistant district attorney.

In small,underfunded counties, this is the only way that the county can afford to pay a DA, is to allow a private civil practice on the side. Occasionally, there may be a conflict, as a civil and criminal case can sometimes overlap. In such a case it is the DA's responsibility to step out of both cases. If he/she does not do so voluntarily, then the opposing counsel will petition the judge to order it.
