Legal Question in Family Law in Texas
Possible probate
Our will is set up that upon the first to die, then one half of the estate goes in to a seperte account/trust.
Then will that have to go to an attorney and have it probated.

This is really the wrong category for this question and there isn't exactly a clear question, but even so, without knowing what property there is there is no real way to answer. Putting everything into a trust of the death of the first to die does not avoid the need for 2 separate probates.
