Legal Question in Family Law in Texas

I am in the process of adopting my step son. his father has been absent for three years, is not on the birth certificate and son knows nothing of him. Now the biological father wants to start seeing him. What kind of legal mess are we looking at and what kind of rights will he have?

It will not make much difference because in order to adopt you will have to serve the person that is thought to be the father anyway. After that the court will decide if that person's rights should be terminated or continue. If they are terminated, then you can begin the process to try and adopt the child. If he is determined to be the father and his rights not terminated, the court could grant him visitation or even custody (whatever is in the best interest of the child).
