Property belongs to spouses family but, mobile home belongs to us

My 20 yr. Common Law Marriage is ending. We have a 16 yr old son together. My spouse is the one who is so unhappy & wants out. He is never here until night time. He sees our son every morning when he takes him to school, ( 5 minute ride). My real problem is that in 1995 we moved into a home ton land that was owned by his Father & Uncle. In 2003 we purchased a mobile home because the house was in extremely. bad shape. We put the mobile home in front of the house on his families land. I don't wish to uproot my son & move from the only home he has ever known. If my spouse is so unhappy I feel he should go. What are my rights regarding the home & land?

Mobile home is community property because is was purchased during marriage (unless it was purchased with separate property funds). You do not say that the family conveyed the land to anyone. If not then you have not rights to the land.

If the home is community property you have 1/2 interest in it.

All of this assumes that you do in fact have a common law marriage.

In order to establish your rights to the home you will need to see an attorney.
