Legal Question in Family Law in Texas

Property-divorce

I got a divorce and did not list my house as property. I did not obtain a signature for the divorce from my ex because I do not know where he is. Can this divorce be amended to include the house, because I do not know where he is? The last time I spoke with him was Oct 01 and he stated that he was moving to Mexico. My divorce was final in Dec 01.

Re: Property-divorce

You should discuss this with the lawyer who represented you in your divorce, or a different lawyer if you prefer. There is a procedure to divide property not listed in a divorce decree, but that is not the same thing as changing the decree itself. You do not give sufficient information to state how you obtained the divorce, and I am guessing it was by a default judgment. Perhaps the thing which will help you in the long run would be the statute of limitations on real estate (adverse possession), but those issues should be discussed with a lawyer local to you.
