Legal Question in Family Law in Texas

Propery Divsion-Divorce Final

I did my Divorce Pro-se due to my financial burden. In the matter of Property division-to obtain a signature from the respondent. [which would not agree, and violated the restraining order then the Court helped me to obtain a Protective ORDER issued by the Judge]. Inserted was; When and If I ever remarried he could request me to sell the residence. I remarried 2 yrs ago, he has never, until I divorced my husband which I married in Oct 1999 obtained an attorney to take action for forcing me to sell my home. I have maintained my home, paid the taxes. I need advice on how to proceed legally for his cooperation of the selling of that residence. He OWNS his own residence and I am the sole possessory conservator, care taker of our minor son which came from this marriage. He owes me child support, I'm disabled, and residing with my family. Any TEXAS state laws to help me understand how to force the process of selling, so I may provide a home for my minor son and myself.

What is the time limit or if statue of limitation in regards to such a legal termonology? ANY response is appreciated. THank you for your consideration.

First, if he hasn't paid you child support, you can hire an attorney to file contempt motion against him and get the support and attorneys fees. As far as the house is concerned, if the decree says you have to sell the house if you remarry, then you may have to do that and split the proceeds with him (it doesn't sound like you have the money to buy out his half).
