Protection Orders and Child Custody

After a big arguement, my live-in girlfriend left our two-year-old daughter with a babysitter and called me threatening to turn our child over to children's protective services. I have documentation stating that I have ''custody'' and I was to stay away from my girlfriend. Meantime, unknowing to me at the time, my girlfriend had put a protective order out on me. Not once, but twice. The second one was to be in effect for a year (expired in Feb. 2003). Six months later we were together for a child visit and I was arrested for protective order violation. She bonded me out and we left the state together. While in the other state another fight between us and she disappeared with the child. My questions: I've jumped bond on the charge. What COULD the worse-case senario be? And do I still have legal custody of my daughter? In other words, is this a kid-napping situation? I'm not sure which way to best handle the situation and I miss my daughter!

As there is likely a warrant for your arrest, it is difficult for you to call the police, though in a kidnapping situation, you would probably be best adivsed to have the money for the bond and call the police. That would be your second call, however. Your first call is to a lawyer practicing in the county where the custody case and the protective order matter were filed. You should do that today. I will practice in Tarrant, Dallas, Wise and Denton counties.
