Protective Order Statute

I have lived with my boyfriend for 9 years. The last year he moved to another state for work. Relationship deteriorated. Has now returned. We agreed he would return and we would live together...trial basis. Upfront as just friends. If relationship could be resurrected, we would go from there. The residence is the same house we rented together...I continued to have it as my home when he left....there is not a lease. He tried to have me locked out last night as he was angry with me and his ego hurt. He called the police...they of course said he had to let me stay. What should I further do to protect myself or how vulnerable am I to getting locked out of my own home?

Get a rental contract in your name. Even if it's only month to month rental, with your name on it, your boyfriend then becomes a guest; and you can ask him to leave at any time.

"Protect" yourself? From what? Were you just locked out or was there more. Do you feel threatened? Has he committed any violence? Are you afraid that he will commit violence?

Since your heading referred to protective orders I assume that one or more of the above might be applicable. If so, then you have two choices (I am assuming that you live in Texas). First, if your protection is the only issue, then call your county district attorney's office and ask for their protective order division. They can help you through the process and even represent you in court.

If there are any other issues such as children or property issues, that need to ultimately be resolved, call a private attorney who can obtain the protective order in the process of protecting your other rights. Protective orders during the pendancy of a divorce action, for example, happen all the time.
