proxy marriage

If a marriage was taken place when one of the spouses was incarcerated (proxy) and another person had to stand in the place of the incacerated spouse is this a legally bound marriage being that the incarcerated spouse wasn't present in the ceremony?

Re: proxy marriage

Marriage by proxy is allowed by Texas Law and creates a legally binding marriage which terminates by death or suit granting divorce or annulment.
