Legal Question in Family Law in Texas

Qdra

My husband & I have been separated for 4 months. He plans to file for divorce soon. Hehas a large pension plan. He worked for a law enforcement agency and has just recently been fired from his job. This is not 401K. He plans to take all of his money out of the plan. We have been married for 17 years. Can I file a QDRA form myself with the county where he works if I have the proper form without going through an attorney?

Re: Qdra

You obviously need an attorney!

It's QDRO -- not QDA.

You must file for divorce and ask for immediate temp. orders so that he's ordered not to hide the money or spend it.

If the money "disappears" then the asset is gone!

You need an attorney asap.

A QDRO is part of a property division.

You can't do a QDRO without a divorce and a property division.
