Legal Question in Family Law in Texas

I have a QDRO against my ex wife's Pension plan. She retired this year. The Pension plan she had is telling me my only option to receive the money is by a Monthly draw. Is this true?

It is true if the plan only offers a monthly payment option.

It's also true if the plan offers other options but the QDRO restricts your share of the benefit to a monthly payment.

Ask the plan administrator for a copy of the summary plan description to review the plan's payment options. You'll have to review the QDRO or allow an attorney to review the QDRO to determine if the order places any limitations on how you can receive payment.
