Legal Question in Family Law in Texas
I have a qudro for my ex husbands pension at general dynamics. He can take his as a lump sum but they say that I cannot. Is there a way to fight it and is it worth it. HE had 26 years in when we divorced. they told me at the beginning that the money would be separated and I would make no interest. the qudor was drawn up in OH but I live in TX. I am currently disabled if that makes a difference. Another thing , how d I know if the amount they say I should get each month is correct. I have no way of checking. divorced in 2002

Use the QDRO to get the fund administrator to roll over YOUR money into your own IRA (this won't cost you anything). Then cash THAT in. There will be a tax penalty; this is unavoidable.
And it's difficult to make sure that they get the amount right; it has a lot to do with how the decree is worded.
