Legal Question in Family Law in Texas

Question about child custody?

I just had a baby and the guy who believes he is the father wants to take me to court, he says he already signed the papers for him to pay child support and that they are in process right now. When i had him I did not put him on the birth certificate as the father of my child. He says he can change the last name to his and he wants to do that just because, can he legally do that just because he is going to be paying child support? Can the child have both of our last names instead of just his or just mine, if he just wants his. The baby is not even a month old, what will the visitation rights be as well if I am breastfeeding him, I do not want him to take him overnight, especially while breastfeeding. What will his visitation rights be?

Re: Question about child custody?

You definately need to talk to an attorney.

If you are breastfeeding, then visits will be based on the baby's eating schedule. I encourage you to breastfeed as long as you can since doctors claim breastfeeding is so good for babies.

Yes, you can give the baby your last name and his last name.

If you want, you can ask for DNA testing to determine if this man is the father.

If you live close to Houston, call me. I charge $50 for approx. an hour phone call or $100 to sit down face-to-face with you.

Congratuations on your new addition! All the best.
